It must be understood that the word "sit down" implies a regular, systematic drinking by a person of such a substance in excessive quantities.
For example, a child under the age of 18 wakes up at home in the morning and drinks a jar of caffeine, goes to school, and on the way consumes another jar, at recess another one, on the way home another, at home before bed to improve dreams - drinks the final jar. As you know, if the drink does not contain alcohol, you can sell it to everyone without restrictions. Both earlier and in 2018, there are no restrictions in the Federal Law in this case either by age or by the number of cans or bottles purchased. Therefore, in many subjects of the Russian Federation, a child under 18 years of age may well come to the store and stock up on a bunch of jars with the desired liquid. Is it correct? It appears not. So, in my law practice, I remember there was a case related to compensation for moral damage and harm to health by a parent who was poisoned by a liquid with a high content of caffeine. A twelve-year-old child easily bought three jars in the store and drank them with a friend.
However, legislators at the federal level have not yet matured with the proper conclusions on this issue. For this reason, regional laws have appeared, for example, in Moscow, the Moscow region, Yano, Ivanovo, Kursk, Orenburg regions, etc. - prohibiting children under 18 from selling any energy drinks, regardless of the presence of ethyl alcohol in them.

It can be unequivocally said that the actions of persons who refuse adult citizens in the purchase of strong alcoholic beverages are illegal. The fact is that the conditions for the retail sale of alcoholic beverages are established by the federal law of November 22, 2005 No. 171-FZ “On state regulation of the production and circulation of ethyl alcohol, alcoholic and alcohol-containing products” (hereinafter referred to as the Law). According to paragraph 2 of Art. 16 of the Law does not allow the retail sale of alcoholic products to minors.

Minors in the Russian Federation are persons under the age of 18 years. Alcoholic products include food products that are produced using ethyl alcohol produced from food raw materials and (or) alcohol-containing food products with an ethyl alcohol content of more than 1.5 percent of the volume of the finished product.
In case of doubt that a person has reached the age of majority, the seller has the right to demand from this buyer an identity document that allows to establish his age. If the document is not provided, you may be denied the sale of any alcoholic products. In addition, the Law allows for additional restrictions on the sale of alcohol at night, up to a complete ban. However, the restriction does not apply to establishments providing catering services. Federal legislation does not contain other restrictions related to the age of the buyer.
The constituent entities of the Russian Federation also do not have the authority to increase the age from which the sale of alcoholic products is allowed. As for individual establishments providing catering services (restaurants, bars, cafes), these establishments, carrying out the retail sale of alcoholic products, in accordance with Art. 492 of the Civil Code of the Russian Federation are obliged to conclude an agreement with each applicant on equal terms (public agreement).
Thus, the refusal of a commercial organization to conclude a public contract, if it is possible to provide the consumer with the relevant goods, is not allowed and is in itself illegal. I would like to draw your attention to the fact that additional conditions for the sale of products can be established by catering establishments independently, however, they cannot contradict the legislation of the Russian Federation (clause 5 of the Rules for the provision of catering services, approved by Decree of the Government of the Russian Federation of August 15, 1997 No. 1036). The ban on the sale of alcoholic products to persons under the age of 21 contradicts paragraph 2 of Article 16 of the Law.
Therefore, upon presentation of an identity document and proof of age (from 18 years old), refusal to sell alcoholic beverages (regardless of its strength) will be illegal.
